These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and all health, wellness, and consulting services (collectively, the "Services") provided by Health Immune Care LLC ("Company", "we", "us"). Please read them carefully.

By registering, booking, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part, please do not use the Services.

1. Eligibility

You must be at least 18 years old to create an account or book services directly. For minors, a parent or legal guardian must register and consent on their behalf. By using the Services, you represent that you have the legal capacity to enter binding contracts in your jurisdiction.

2. Medical Disclaimer

All diagnoses and treatment decisions are made individually between you and your licensed provider. Always consult a qualified physician before starting any new diet, exercise, or supplement regimen.

3. Services Overview

Health Immune Care offers a range of services including but not limited to: primary care consultations, dental care, nutrition and weight loss coaching, hair and skin treatments, joint and bone health programs, cardiovascular care, gender-specific healthcare, memory and neurological wellness, and health insurance advisory.

Specific offerings, pricing, and availability may vary by state based on licensing and regulatory requirements.

4. Membership & Payment Terms

4.1 Billing

Memberships are billed monthly or annually in advance via the payment method on file. Prices are listed in U.S. dollars and exclude applicable taxes.

4.2 Cancellations & Refunds

• You may cancel your membership at any time from your account portal. Cancellation takes effect at the end of your current billing cycle.
• New members enjoy a 30-day satisfaction guarantee: if you are unsatisfied within the first 30 days, contact us for a full refund.
• After 30 days, memberships are non-refundable but may be paused for up to 3 months per year for qualifying life events.

4.3 Late Payments

Failed payments may result in a temporary suspension of services after 7 days. A $15 late fee applies to balances over 30 days past due.

5. Your Responsibilities

When using our Services, you agree to:

• Provide accurate, current, and complete information during registration and consultations.
• Promptly update your account if any information changes.
• Maintain the confidentiality of your login credentials.
• Follow the care protocols and recommendations provided by your healthcare team.
• Disclose all relevant medical history, medications, and allergies to your providers.

6. Prohibited Conduct

You may not:

• Use the Services for any unlawful purpose or to transmit harmful code.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Resell or sublicense Services without written permission.
• Submit false insurance claims or misrepresent your identity.
• Harass, threaten, or abuse our staff or other users.

Violations may result in immediate account termination and referral to law enforcement where appropriate.

7. Intellectual Property

All content on our website, including text, graphics, logos, protocols, educational materials, and software, is the property of Health Immune Care or its licensors and protected by U.S. and international copyright, trademark, and patent laws.

You may view and print materials for personal, non-commercial use only. Any other use requires our prior written consent.

8. Third-Party Links & Services

Our Services may contain links to third-party websites or integrate third-party services (labs, pharmacies, insurance carriers). We are not responsible for the content, accuracy, or practices of these third parties. Your use of such services is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Health Immune Care and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of such possibility.

Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Health Immune Care from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

11.2 Arbitration

Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association in Auburn, Alabama, except for small claims matters that qualify for court resolution.

11.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class or representative actions.

12. Service Availability

We strive for 24/7 availability but do not guarantee uninterrupted access. Scheduled maintenance, outages, and force majeure events (natural disasters, pandemics, cyberattacks) may temporarily affect service delivery.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.

14. Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms, fail to pay, or remain inactive for more than 12 months. Upon termination, your right to use the Services ends immediately, though certain provisions (payment obligations, indemnification, dispute resolution) survive.

15. Severability

If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Health Immune Care regarding the Services and supersede all prior agreements.
